ITAT Quashes Tax Notice Despite Rs 5.2 Crore Cash Deposit and Rs 7.65 Lakh ITR

The Assessing Officer (AO) has issued multiple notices to a taxpayer regarding a significant cash deposit, seeking clarification on the source of the funds and information related to the individuals Income Tax Return (ITR). The taxpayers responses to these inquiries did not meet the satisfaction of the tax department, prompting the AO to issue an assessment order. As a result, the AO classified the deposit of Rs 5.2 crore as unexplained money, invoking Section 69 of the Income Tax Act, which addresses unaccounted income.

Under Section 69, authorities are empowered to treat certain transactions as income when the taxpayer does not provide satisfactory explanations regarding their origins. This decision may carry implications for the taxpayer, including potential penalties and interest on unpaid taxes associated with the unexplained amount. It is advisable for individuals involved in similar situations to consult with a tax professional to understand their rights and obligations in such matters.
