UDF Governments Position on PM SHRI Program Raises Constitutional Concerns
A memorandum of understanding (MoU) has been signed between the Secretary of the Education Department of the Government of Kerala and the Additional Secretary of the Department of Education in the Government of India. However, concerns have been raised regarding the legitimacy of this agreement, as it was not executed in the names of the President and the Governor, which is a requirement under Article 299 of the Indian Constitution.
Article 299 stipulates that contracts made in the name of the Government of India must be signed by the President or a person authorized by him, while contracts for state governments require the signature of the Governor or a designated representative. As a result, this oversight has led to assertions that the MoU may not hold legal validity.
The implications of this development could affect various educational initiatives and collaborations outlined in the MoU, as compliance with constitutional procedures is essential for the enforceability of such agreements. Further clarifications may be necessary from both state and central authorities regarding the next steps in light of this situation, especially in terms of ongoing education programs and funding aligned with the objectives of the MoU.
